The restaurant got a cease-and-desist letter over its name: The Rolling Stone Libation Company." The magazine claims trademark violation. The owner insists that the name predates the magazine and therefore... well, see, it obviously DOES predate the magazine (gathers no moss, etc.), but you CAN trademark something like that if it gains secondary meaning specific to your business. And the restaurant happens to have a rock music theme and the sign, with slightly different font, could be seen to evoke the magazine. Guy probably should be consulting a lawyer. (WBBH-TV/Fort Myers)
