Hey, remember that woman who complained that her t-shirt design was stolen by Target? That may be the case, but people diving into her designs discovered something else: One of her other designs is a copy of a Tootsie Pop design -- it's the Native American boy with a bow on the wrapper. She responded that candy is not apparel and putting the logo on a t-shirt is "transformative" like Andy Warhol's Campbell Soup can. Um, no, it's a trademark and the Tootsie people have a right to it. Yes, that's different from stealing a t-shirt design, which is the same item copied and sold, but you can't sell someone else's intellectual property just because you slapped it on a t-shirt.
