Should Have Worn A Helmet

A fan whose face was mangled by a foul ball at Yankee Stadium sued, and he's lost, because, the court ruled, of the stuff on the back of the ticket, the assumed-risk language, and should have anticipated that people hiding umbrellas could block his view. (They let people open umbrellas at a baseball game?) Is that fair these days, especially now that we know that netting COULD be extended to the foul poles with no problem but that teams have resisted doing so? Should they be able to unilaterally dismiss their own liability and make that a condition of attending the game? (New York Post)
