The lawsuit by two former Hooters waitresses who claim they were fired for being too fat can proceed, a judge has ruled, saying that the arbitration clause they signed may not have constituted knowing waiver of their rights. So, your topic is back, whether an employer can prescribe a particular look for its employees. I'm sure the women in question wouldn't qualify as "fat" in most circumstances, but if you're the kind of guy who goes to a Hooters ("for the wings," I'm sure), are you going to be disappointed if the waitress is a little more curvy or even, um, "thicker" than the usual Hootron?
